General Terms and Conditions (GTC)
1. Scope
The General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all legal transactions concluded via the event platform ‘Le petit calendrier’ (hereinafter referred to as ‘LPC’). The event calendar is operated by Bärnermamis GmbH.
2. Scope of application
Bärnermamis GmbH (hereinafter referred to as ‘Bärnermamis’) operates the domain lepetitcalendrier.ch (hereinafter referred to as “website”). These GTC govern the relationship between the user and ‘Bärnermamis’ and regulate all use of the services and products offered on the website. By using the website, the user accepts these terms and conditions.
3. Copyright
Unless otherwise stated, all copyrights, rights of use and other rights to the content displayed on the website are the exclusive property of Bärnermamis. The content is only approved for interactive use by natural persons. Any other use or storage for public or commercial purposes, whether in electronic or non-electronic form, requires the express consent of Bärnermamis. In addition, the express mention of the source ‘Bärnermamis’ is required in the event of republication. Downloading or printing content for private use is not permitted. Neither copyright notices nor other legally protected designations may be removed. Any third-party property rights that would be restricted by the scope of use granted here remain reserved. Bärnermamis cannot guarantee that the use of content provided by third parties on this website is legally permissible. The consent of the third party must therefore be obtained before use.
4. Liability
The content published on the website has been compiled with the utmost care. Nevertheless, the correctness, accuracy, completeness, reliability and timeliness of the information provided on the website cannot be guaranteed. Bärnermamis accepts no liability in this regard. The use of such information and data is at the user's own risk. Bärnermamis offers third-party offers and information (advertising) on the website. Bärnermamis accepts no liability or responsibility for the availability or performance of these offers and information.
Liability for damage caused by computer viruses, spyware and other harmful computer programs is also excluded. Bärnermamis is also not liable for interruptions in service caused by malfunctions of any kind or for the purpose of troubleshooting, maintenance and the introduction of new technologies.
The provider's websites may contain links to websites operated and maintained by third parties. The provider controls access to third-party websites via links, but not the content and applications found on third-party websites. Accordingly, the provider cannot accept any responsibility for the content and applications on third-party websites.
5. Responsibility for user content and data
Bärnermamis accepts no responsibility for the content, data and/or information provided by users or for content on linked external websites. In particular, Bärnermamis does not guarantee that this content is true, fulfils a specific purpose or can serve such a purpose. The user acknowledges in particular that Bärnermamis is not obliged to monitor the content of posts provided on the network.
If the user notices any use of the network that is contrary to the law or the terms of the contract (including the use of abusive names or misleading identities), they can report this by email to info@lepetitcalendrier.ch.
6. Indemnification
The user indemnifies Bärnermamis against all claims, including claims for damages, that other users or other third parties assert against Medienatelier due to an infringement of their rights by the content posted by the user. The user further indemnifies Bärnermamis against all claims, including claims for damages, asserted by other users or other third parties against Bärnermamis due to the violation of their rights by the user. The user shall bear all reasonable costs incurred as a result of a violation of third-party rights, including reasonable costs incurred for legal defence. All further rights and claims for damages by Bärnermamis remain unaffected.
7. Terms and conditions for online and social media prize draws
All readers of lepetitcalendrier.ch and persons of full legal capacity who are at least 18 years of age and reside in Switzerland are eligible to participate, unless otherwise specified.
The winner will be determined by a random generator. Only participants with Facebook or Instagram accounts that represent a person with the correct name are permitted to enter. Participation with fake identities or with the identities of third parties is not permitted.
Bärnermamis is authorised to change the conditions of participation at any time without giving reasons. The changes will not be sent to participants by email. Bärnermamis accepts no liability for the publication of incorrect information. It also accepts no liability if data entered in forms, emails or comments by participants does not meet the requirements and is therefore not recognised by the system. If technical or legal reasons prevent the smooth running of the prize draw, Bärnermamis may terminate the prize draw at any time without giving reasons.
Bärnermamis reserves the right to disqualify participants without giving reasons and to exclude them from the prize draw. This applies in particular if participants attempt to manipulate their participation or violate the conditions of participation.
Further conditions for participation are explained in the respective post. The duration will be announced in connection with the respective prize draw.
The winners will be notified in writing. No correspondence will be entered into regarding the prize draw. Cash payments and legal recourse are excluded.
